Apex, NC asked in Child Custody and Family Law for North Carolina

Q: Can a single mom represent herself in a child custody case without legal aid?

I am a single mom with no legal training and I can't afford to hire a lawyer. I'm trying to reach out to legal aid but haven't had success yet. Can I successfully represent myself in a child custody case, and are there any resources or support I might not be aware of that could help me understand the legal process?

A: Yes, you can represent yourself in a child custody case, but it will require time and effort to understand the legal process. Many people handle custody cases on their own, known as "pro se" representation. While it’s possible to do this, it’s important to be prepared and knowledgeable about the laws that apply to your case, especially since child custody decisions are based on what’s in the best interest of the child.

There are resources that can help you navigate the process. Many courts offer self-help materials, workshops, and forms that you can access online or at the courthouse. You can also look into local family law clinics or public legal libraries where you might get some guidance without hiring a full-time lawyer.

While legal aid services can be valuable, if you're having difficulty reaching them, you might want to explore online resources, legal forums, or consult with a lawyer for a one-time consultation. Even without full legal representation, these resources can help you better understand your rights and how to effectively present your case.
